1. Acceptance of Terms

By accessing and using MidwifePlus ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

MidwifePlus is a digital platform that connects professional midwives with families seeking Postnatal Care services across the United Kingdom. We facilitate communication, appointment scheduling, care planning, and clinical documentation.

3. User Eligibility

3.1 For Clients

You must:

  • Be at least 18 years of age
  • Be legally capable of entering into binding contracts
  • Provide accurate and complete information
  • Reside in the United Kingdom

3.2 For Midwives

You must:

  • Hold valid registration with the Nursing and Midwifery Council (NMC)
  • Maintain current professional indemnity insurance
  • Comply with all relevant healthcare regulations and standards
  • Provide proof of qualifications and undergo verification

4. User Accounts

When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your password and account
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account
  • Not share your account credentials with others

5. Professional Services

5.1 Nature of Relationship

MidwifePlus acts as a platform facilitator. The professional relationship is directly between the midwife and the client. We do not provide medical services or employ midwives.

5.2 Professional Standards

All midwives must adhere to NMC Code of Conduct, maintain professional boundaries, and provide care in accordance with current evidence-based practice.

6. Payments and Fees

6.1 Service Fees

Clients agree to pay for services as agreed with their midwife. MidwifePlus may charge platform fees as outlined during registration.

6.2 Payment Processing

All payments are processed securely through our third-party payment providers. You agree to provide valid payment information and authorize charges.

6.3 Refunds and Cancellations

Refund and cancellation policies are determined by individual midwives and must be clearly communicated to clients before service commencement.

7. User Conduct

You agree not to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit harmful or malicious code
  • Harass, abuse, or harm other users
  • Impersonate others or provide false information
  • Attempt to gain unauthorized access to the platform
  • Use the platform for any unlawful purpose

8. Confidentiality and Data Protection

All users must maintain confidentiality of sensitive information. Healthcare professionals must comply with patient confidentiality requirements under UK law and professional standards. See our Privacy Policy for details on data handling.

9. Intellectual Property

All content, features, and functionality of the Platform are owned by MidwifePlus and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

10. Disclaimers

10.1 Platform Availability

We strive to maintain platform availability but do not guarantee uninterrupted access. We may suspend services for maintenance or updates.

10.2 Medical Advice

MidwifePlus does not provide medical advice. All clinical decisions are made by registered healthcare professionals. In emergencies, contact NHS 111 or 999.

10.3 Third-Party Services

We are not responsible for the quality, safety, or legality of services provided by midwives or the conduct of users.

11. Limitation of Liability

To the fullest extent permitted by law, MidwifePlus shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount paid by you in the past 12 months.

12. Indemnification

You agree to indemnify and hold harmless MidwifePlus from any claims, damages, losses, or expenses arising from your use of the Platform or violation of these Terms.

13. Termination

We may terminate or suspend your account if you:

  • Violate these Terms of Service
  • Engage in fraudulent or illegal activity
  • Pose a risk to other users or the platform
  • Fail to maintain required professional credentials (midwives)

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of England and Wales.

14.2 Dispute Process

Any disputes should first be addressed through our internal complaints procedure. If unresolved, disputes may be subject to mediation or arbitration before court proceedings.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or platform notification. Continued use after changes constitutes acceptance.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
